Step 1: The Original Petition and Standing Orders
The process begins by filing an Original Petition for Divorce in the Dallas County District Courts. Once filed, your case will be assigned to one of the dedicated family district courts located in the George L. Allen, Sr. Courts Building in downtown Dallas.
Crucially, Dallas County has 'Standing Orders' that automatically go into effect the moment a petition is filed. These orders act as a legal restraining order to prevent either party from hiding assets, cancelling insurance, or harassing the other party while the divorce is pending.
Step 2: Legal Notice and the 60-Day Waiting Period
After filing, the other spouse must be formally notified. This is done either through a process server or, if the divorce is amicable, the spouse can sign a 'Waiver of Service.'
