The recent passing of actress Shannen Doherty has been met with an outpouring of grief and remembrance. Known for her iconic roles on “Beverly Hills, 90210” and “Charmed,” Doherty’s life was a blend of public triumphs and private struggles. Her brave battle with breast cancer and her highly publicized divorce from Kurt Iswarienko brought significant attention to her personal life.

Health issues can have a profound effect on divorce proceedings. In Doherty’s case, her battle with cancer likely influenced the legal aspects of her separation from Iswarienko. Divorce settlements often involve discussions about the division of assets and spousal support. In Doherty’s case, she signed her divorce papers just one day before losing her years long battle with cancer. Her then-husband signed the day of her passing. Doherty originally wanted spousal support from her Iswarienko, but she ultimately decided to waive her spousal support. In their proposed agreement, Doherty was awarded the couple’s marital home in Malibu, California, a Salvador painting, several cars, and all the earnings from her acting career. The divorce was not signed by the Judge until after she had passed.

Courts don’t often see divorce cases that require a judge’s signature after one party has died. In most states, including California, family law courts lose jurisdiction when someone dies during a divorce, and the case is handled in probate court. However, if all procedural requirements are met and the appropriate paperwork is submitted, the judgment can still be entered. In Doherty’s case, the Court chose to enter the Judgment, consistent with the couple’s wishes. Since Doherty did not have any children, it remains unclear who her assets may go to.
